Former Bordentown Physician Indicted

FORMER BORDENTOWN NEW JERSEY PHYSICIAN INDICTED FOR NARCOTICS DISTRIBUTION AND FRAUD

" Morris " Moishe" Starkman Of Cinnaminson Indicted On 15 Counts Of Narcotics Distribution & 5 Counts Of Health Care Claims Fraud."

December 26, 2021 By Art Fletcher Reporting For: Englebrook Independent News,

MOUNT HOLLY, NJ.- On Tuesday, December 14, 2021 Burlington County Prosecutor Scott Coffina announced that a Grand Jury sitting in Burlington County, New Jersey has returned an Indictment against a former physician on Twenty One Counts of Narcotics Distribution and Fraud Charges for Illegally Prescribing Thousands of Highly-Addictive Opioid Pills out of his Bordentown Township, New Jersey  practice while simultaneously engaging in an Unlawful Medical Billing Scheme over a Three-Year Period.

Morris “Moishe” Starkman, 62, of Cinnaminson, New Jersey was Indicted by a Grand Jury on Fifteen Counts of Second Degree Distribution of a Controlled Dangerous Substance; Five Counts of Second Degree  Health Care Claims Fraud; and One Count of Third Degree Insurance Fraud. The Indictment was returned November 19, 2021 and signed by First Assistant Prosecutor Philip S. Aronow. An arraignment will be held soon in Superior Court.

Mr. Starkman was originally Charged on November 22, 2019, following the execution of a search warrant at his home during which multiple electronic devices were seized, along with business, financial and medical records.

The investigation determined that between January 1, 2015 and January 1, 2018, Mr. Starkman issued Prescriptions through his Bordentown Family Practice for nearly 1,400,000 total doses of Opioids, including Oxycodone, OxyContin, Percocet, Roxicodone, Endocet, Hydrocodone, Vicodin, Norco, Lorcet, Lortab, Oxymorphone, Opana, Hydromorphone, Dilaudid, Morphine and Fentanyl.

The Eight Patients outlined in the Criminal Charges filed against Mr. Starkman received Eleven Doses of Opioids per day on average during that period. One patient alone was prescribed 17,460 doses, which equates to more than Fifteen per day. They each received anywhere from Four to Ten Times the Maximum Dose recommended by The Centers for Disease Control and Prevention.

The investigation revealed that Mr. Starkman would perform, at most, cursory examinations on patients before Prescribing Large Amounts of Opioids without Medical Justification, consideration of whether his patients were benefitting from the prescription painkillers he routinely and repeatedly prescribed, or exploration of the underlying causes for their pain.

Mr. Starkman maintained inadequate records on his patients which failed to document treatment plans for pain management or opioid use, or provide a legitimate medical purpose for prescribing such high quantities for an extended period of time. The reliance of his patients on the highly-addictive opioids he was prescribing insured they would frequently return to the practice for refills and be charged for an office visit.

“Hundreds of thousands of Americans have died from overdoses and millions more struggle with Substance Use Disorder,” Prosecutor Coffina said. “In a great many of these cases, the person’s addiction began with prescribed opioids. Physicians who violated their oaths and patients’ trust by indiscriminately prescribing opioid medication without monitoring how their patients were doing on the drugs and whether they were becoming addicted must be held accountable for criminal conduct that has contributed to the destruction of lives and the relentless crisis of addiction so many are still dealing with.”

The investigation also revealed that Mr. Starkman, during that same time, submitted fraudulent health care claims to insurance companies for over $50,000 for services that were unauthorized, not eligible for reimbursement, not provided as represented or not rendered.

Mr. Starkman first came to the attention of Law Enforcement Officials in late 2016 after an insurance company contacted Authorities with a Suspicion of Illegal Activity at his practice due to the high volume of Opioid Prescriptions he was writing.

The State Board of Medical Examiners temporarily suspended Mr. Starkman’s License in August 2017. Under a consent order reached in April 2018, Mr. Starkman agreed to permanently surrender his License to Practice Medicine in New Jersey.

Records seized from Mr. Starkman’s Practice revealed that one of his Patients Fatally Overdosed in May 2015, two months after his last visit to the Bordentown office.

The records indicated that during a visit in December 2014, Mr. Starkman continued to prescribe Oxycontin to the patient, despite noting that he was “Slurring and Falling Asleep” during the visit. The following month, when the patient visited the office because he was “Sick” and “Ran Out of All Meds Early Again,” Mr. Starkman wrote him a prescription for a higher dosage of Oxycodone. During the patient’s final visit in March 2015, Starkman prescribed him 120 additional Oxycodone pills, despite noting that three days earlier he had been discharged from week-long stay at a mental health and addiction treatment facility where he had sought help for anxiety and panic attacks.

Due to insufficient evidence connecting his prescriptions to the patient’s fatal overdose, Mr. Starkman was not Criminally Charged in connection with the Patient’s Death.

Governor Murphy Blocks Bear Hunt

NEW JERSEY'S GOVERNOR MURPHY BLOCKS PROPOSAL BY NEW JERSEY FISH AND GAME COUNCIL'S BLACK BEAR HUNT

" As New Jersey's Black Bear Population Continue To Increase, Murphy & NJDEP Commissioner Shawn LaTourette Block Emergency Order Allowing Hunt Potentially Placing Residents In Danger."

December 23, 2021 Opinion By Ryan Metz Science & Nature Staff Writer For: Englebrook Independent News,

TRENTON, NJ.- In September 2021, The New Jersey Fish and Game Council unanimously approved an emergency order allowing a Black Bear Hunt in New Jersey. Governor Phil Murphy refused to approve the order, as did New Jersey Department of Environmental Commissioner Shawn LaTourette. Murphy was quoted as saying, " There will be no bear hunt this year. Period. I can say that definitively." Instead of a bear hunt Murphy has proposed increasing non-lethal means of managing the bear population including the hiring of a Bear Conservation Officer. But, there is a problem with this approach, and it isn't the effectiveness of non-lethal management, it is the decision making process that has brought us to this point.

The Fish and Game Council's purpose is to set regulations to effectively and responsibly manage the wildlife that may be hunted or harvested within the State's boundaries. The Council is comprised of people with the education and experience, and who have a vested interest in managing populations to be healthy and sustainable.

So why would the Governor ignore them? The Fish and Game Council submitted for approval a new comprehensive Black Bear Management Plan, ( the previous plan expired in June)that include limited hunting as a management tool. This plan has yet to be approved by Commissioner LaTourette, which means there can be no hunt as long as the plan is not in place, but it also means that we do not have a Fish and Game Council approved comprehensive management plan. Just think of those words for a moment.  "Comprehensive Management Plan." If the non-lethal management was deemed sufficient, the plan would have called for that.

This brings us to the next point. What plan is the Governor currently using? If there is no approved plan, how is The Governor's Administration and The Department of Environmental Protection suppose to carry out their duties regarding the management of this natural resource? This is irresponsible at best and potentially deadly. New Jersey has the highest density of Black Bear and Residents in The United States. The probability of dangerous Black Bear Human Encounters increases with their population, not only because there are more of them, but also the increase in Black Bear population puts a strain on the environment to support the bear's existence. These Bears will have forage further distances to find food. This is not good for residents or bears.

Here is a Governor that is not heeding to data, not listening to The Fish and Game Council, but is abdicating responsibility just because a small number of residents do not like hunting and Murphy wants their votes. Do you know anyone that would have not voted for Murphy if he didn't stop the bear hunt? I don't. I cannot even think of anyone who would use stopping the bear hunt as their primary political concern. Nor do I know any other candidates that ran on that platform. So what we have is a lapse in a comprehensive management plan for the scoring of political points that were not going to matter anyway.

What makes this even more reprehensible, is that New Jersey cannot afford to manage well what remaining natural resources we have. Everyday open space in New Jersey is being converted to Apartment Complexes and Cluster Zone Housing Developments. Our natural resources are being stressed and stretched to their breaking point, and the lack of a comprehensive management plan for the Black Bear population will not yield good results.

I for one can only hope there will be a legal challenge that will force Murphy to accept The Fish and Game Council's plan, since judging by Murphy's statements, he will not be changing his mind anytime soon.
