35 YEAR OLD PATERSON NEW JERSEY MAN ARRESTED FOR THE CONTINUED SEXUAL ASSAULT OF A CHILD SINCE THE AGE OF EIGHT

PATERSON, NJ.- On Thursday, January 6, 2021 Passaic County Prosecutor Camelia M. Valdes announced the Arrest of Giovani Aguilar, 35, of Paterson, New Jersey. Mr. Aguilar was arrested on Wednesday, January 5, 2022 after an investigation conducted by The Passaic County Prosecutor’s Office Special Victims Unit.
Mr. Aguilar has been Charged with One Count of First Degree Aggravated Sexual Assault; One Count of Second Degree Sexual Assault; and One Count of Second Degree Endangering the Welfare of a Child.
On Thursday, December 2, 2021, The Passaic County Prosecutor’s Office received a report of a 13-Year-Old Child, who disclosed being Sexual Assaulted by Mr. Aguilar since the age of Eight. The Child disclosed being Repeatedly Assaulted by Mr. Aguilar at a residence in Paterson, New Jersey. During the investigation, Prosecutor’s Office Detectives interviewed the Child and Multiple Witnesses resulting in Mr. Aguilar’s Arrest.
If Convicted, Mr. Aguilar will face the potential sentencing exposure on First Degree Aggravated Sexual Assault where the victim is under the Age of Thirteen is Twenty-Five Years to Life in New Jersey State Prison, subject to a Twenty-Five Year parole disqualifier pursuant to The Jessica Lunsford Act; on Second Degree Sexual Assault it is Five to Ten Years in New Jersey State Prison with 85% term of service before parole eligibility pursuant to The No Early Release Act; on Second Degree Endangering the Welfare of a Child it is Five to Ten Years in New Jersey State Prison. Further, if convicted, Mr. Aguilar will be subject to Parole Supervision for Life and Megan’s Law Registration Requirements.
The Passaic County Prosecutor’s Office filed a motion for Pretrial Detention and is asking that Mr. Aguilar be detained in The Passaic County Jail pending the resolution of the case. The detention motion will be scheduled before a Superior Court Judge next week.
