Second Arrest In Wayne Shooting

SECOND ARREST MADE IN THE SEPTEMBER 5, 2021 WAYNE NEW JERSEY SHOOTING

     " Errol Heber Of Passaic, New Jersey Charged With Aggravated Assault & Weapons Related Offenses In Connection To The September 5, 2021 Wayne, New Jersey Shooting."

WAYNE, NJ.- On Wednesday, October 13, 2021 Passaic County Prosecutor Camelia M. Valdes, Wayne Police Chief Jack McNiff and East Rutherford Police Chief Dennis M. Rivelli announced that based upon an investigation by the Wayne Police Department, Errol Heber, 36, of Passaic, New Jersey, was Arrested on Friday, October 1, 2021, in connection to a shooting investigation that took place September 5, 2021, in the area of Mountainview Boulevard and Parish Drive in Wayne, New Jersey. 



     Mr. Heber has been Charged with Second Degree Aggravated Assault; Second Degree Unlawful Possession of a Handgun; Second Degree Possession of a Weapon for an Unlawful Purpose; Second Degree Certain Persons Not to Have Weapons; and Third Degree Hindering Apprehension. 


     As a result of a related investigation by The Wayne Police Department on Monday, October 4, 2021, Mr. Heber has been also Charged with Second Degree Unlawful Possession of a Weapon; Fourth Degree Possession of a Large Capacity Magazine; Fourth Degree Possession of Hollow Nose Bullets; Second Degree Certain Persons Not to Have Weapons; Third Degree Possession of CDS; and Third Degree Possession of CDS with the Intent to Distribute.


     On Tuesday, September 5, 2021, at approximately 2:10 a.m., Members of The Wayne Police Department responded to the area of Mountainview Boulevard and Parish Drive in Wayne, New Jersey on a report of shots fired. 


     Police Officers determined that a gunman later identified as Robert Jackson, 33, of Hackensack, New Jersey had fired a handgun several times in the direction of a 20-year-old male Budd Lake, New Jersey resident, a 22-year-old male Westfield, New Jersey resident, and a 19-year-old male Spring Lake, New Jersey resident. The victims were not injured during the incident. Previously, Robert Jackson was Arrested and Charged in connection with the incident.


     Based on the ensuing investigation, Mr. Heber was identified as an accomplice in the Shooting and a Warrant was issued for his Arrest. On Friday, October 1, 2021, at approximately 11:00 p.m., Members of The East Rutherford Police Department Arrested Mr. Heber during a motor vehicle stop in the area of Route 3 East in East Rutherford, New Jersey. Mr. Heber was Charged with unrelated Narcotics Offenses as a result of the motor vehicle stop in East Rutherford.


The sentencing exposure, if convicted for Robert Jackson and Errol Heber on Second Degree Aggravated Assault is Five to Ten Years New Jersey State Prison with 85% term of service before parole eligibility pursuant to The No Early Release Act and Three Years parole supervision; on each Count of Second Degree Unlawful Possession of a Handgun it is Five to Ten Years New Jersey State Prison with a minimum of Forty Two Months before parole eligibility pursuant to The Graves Act; on Second Degree Possession of a Handgun for an Unlawful Purpose it is Five to Ten Years New Jersey State Prison with Forty Two Months of parole ineligibility pursuant to The Graves Act; on each Count of Second Degree Certain Persons Not to Have Weapons it is Five to Ten Years New Jersey State Prison with a minimum of Five Years before parole eligibility; on Third Degree Hindering Apprehension it is Three to Five Years New Jersey State Prison; on Fourth Degree Possession of a Large Capacity Magazine it is up to Eighteen Months New Jersey State Prison; on Fourth Degree Possession of Hollow Nose Bullets it is up to Eighteen Months New Jersey State Prison; on Third Degree Possession of a CDS it is Three to Five Years New Jersey State Prison; and on Third Degree Possession of CDS with Intent to Distribute it is Three to Five Years New Jersey State Prison.


     The Passaic County Prosecutor's Office has filed a motion for pretrial detention for both defendants that will be heard October 14, 2021, before The Honorable Joseph A. Portelli, J.S.C.
