PASSAIC COUNTY AUTHORITIES BRING FORMAL CHARGES AGAINST A PATERSON MAN IN THE SHOOTING OF AN ILLINOIS MAN

PATERSON, NJ.- On Sunday, September 26, 2021 Passaic County Prosecutor Camelia M. Valdes and Paterson Police Chief Ibrahim Baycora announced that based upon an investigation by The Paterson Police Department, in conjunction with The Passaic County Prosecutor’s Office, Casmir Smith, 19, of Paterson, New Jersey, was arrested in relation to a shooting investigation that took place September 25, 2021, in the area of Presidential Boulevard and West Broadway in Paterson, New Jersey.
Casmir Smith has been Charged with Second Degree Aggravated Assault; Second Degree Possession of a Weapon for an Unlawful Purpose; and Second Degree Unlawful Possession of a Weapon.
On Saturday, September 25, 2021, at approximately 4:43 p.m. Members of The Paterson Police Department responded to the area of Presidential Boulevard and West Broadway in Paterson on a report of a shooting.
Upon arrival, Police Officers located a potential crime scene and a 50-Year-Old Oak Forest, Illinois man who had sustained a non-life threatening gunshot wound. The victim was immediately transported to Saint Joseph’s University Medical Center in Paterson, New Jersey for treatment.
Based on the initial investigation, it was determined that the victim was traveling in a motor vehicle on Presidential Boulevard approaching the traffic light at West Broadway when multiple actors began shooting at unknown persons, with one of the bullets piercing the victim’s windshield and striking him.
Shortly following the incident, Members of The Paterson Police Department apprehended Casmir Smith in the area Broadway and Church Street in Paterson, New Jersey, and he was identified as one of the shooters. Casmir Smith was placed under arrest without incident.
If convicted, The Sentencing exposure for Casmir Smith on Second Degree Aggravated Assault is Five to Ten Years in New Jersey State Prison with 85% term of service before parole eligibility pursuant to The No Early Release Act and Three Years parole supervision; on Second Degree Unlawful Possession of a Handgun it is Five to Ten Years in New Jersey State Prison with a minimum of Forty-Two Months before parole eligibility pursuant to The Graves Act; and on Second Degree Possession of a Handgun for an Unlawful Purpose it is Five to Ten Years in New Jersey State Prison with Forty-Two Months of parole ineligibility pursuant to The Graves Act.
The Passaic County Prosecutor's Office intends to file a motion for pretrial detention that will be heard by a Superior Court Judge.
