A 33 YEAR OLD CLIFTON MAN HAS BEEN ARRESTED IN CONNECTION WITH SEXUAL ASSAULT OF A 14 YEAR OLD

PATERSON, NJ.- On Monday, June 14, 2021, Passaic County Prosecutor Camelia M. Valdes announced the arrest of Javier Beristain, 33, of Clifton, New Jersey. Mr. Beristain was arrested on Friday, June 11, 2021, after an investigation conducted by The Passaic County Prosecutor's Office Special Victims Unit. Mr. Beristain is charged with One Count of First Degree Aggravated Sexual Assault; One Count of Second Degree Sexual Assault, and One Count of Second Degree Endangering the Welfare of a Child.
On June 11, 2021, The Passaic county Prosecutor's Office received a report of a 14-year-old child who disclosed being Sexually Assaulted by Mr. Beristain. The child further disclosed being Assaulted by Mr. Beristain in a residence in Clifton, New Jersey. During the investigation Detectives interviewed the victim and several witnesses, resulting in Mr. Beristain's arrest.
The sentencing exposure on First Degree Aggravated Sexual Assault it is Ten to Twenty years in New Jersey State Prison with a 85% term of service before parole eligibility pursuant to The No Early Release Act; on Second Degree Sexual Assault it is Five to Ten years in New Jersey State Prison with a 85% term of service before parole eligibility pursuant to The No Early Release Act and on Second Degree Endangering the Welfare of a Child it is Five to Ten years in New Jersey State Prison.
The Prosecutor's Office filed a motion for Pretrial Detention and is asking The Court to detain Mr. Beristain in The Passaic County Jail pending the resolution of the case. The detention motion is to be heard by The Honorable Scott T. Rumana, J.S.C. on Wednesday June 16, 2021.
