PATERSON, NJ.- On Tuesday, August 31, 2021 Passaic County Prosecutor Camelia M. Valdes announced that a Grand Jury sitting in Passaic County, New Jersey has returned an indictment against Gilberto Lopez-Rodriguez, 43, of Paterson, New Jersey on multiple counts of sexual offenses against a child.
The Passaic County Grand Jury returned the Indictment, Charging Gilberto Lopez-Rodriguez with various Sexual Offenses against a child that took place at multiple residences in Paterson, New Jersey from February 2014 to February 2015, and then again in January 2020.
Mr. Lopez-Rodriguez was Indicted on Four Counts of First Degree Aggravated Sexual Assault; Five Counts of First Degree Aggravated Sexual Assault; Four Counts of Second Degree Sexual Assault; Five Counts of Second Degree Sexual Assault; Five Counts of Second Degree Sexual Assault; Two Counts of Second Degree Endangering the Welfare of a Child; Seven Counts of Third Degree Aggravated Criminal Sexual Contact; and Two Counts of Fourth Degree Criminal Sexual Contact.
The sentencing exposure on First Degree Aggravated Sexual Assault where the victim is under the age of thirteen is Twenty Five Years to Life in New Jersey State Prison, subject to a Twenty Five Year parole disqualifier pursuant to the Jessica Lunsford Act; on First Degree Aggravated Sexual Assault, it is Ten to Twenty Years in New Jersey State Prison, with 85% term of service before parole eligibility pursuant to The No Early Release Act.
On Second Degree Sexual Assault it is Five to Ten Years in New Jersey State Prison with 85% term of service before parole eligibility pursuant to The No Early Release Act; on Second Degree Sexual Assault, it is Five to Ten Years in New Jersey State Prison with 85% term of service before parole eligibility pursuant to The No Early Release Act; on Second Degree Sexual Assault, it is Five to Ten Years in New Jersey State Prison; on Second Degree Endangering the Welfare of a Child, it is Five to Ten Years in New Jersey State Prison.
On Third Degree Aggravated Criminal Sexual Contact, it is Three to Five Years in New Jersey State Prison; and on Fourth Degree Criminal Sexual Contact, it is up to Eighteen Months in New Jersey State Prison. If convicted, Mr. Lopez-Rodriguez is subject to Parole Supervision for Life and Megan’s Law Registration Requirements. Mr. Lopez-Rodriguez is presently detained at the Passaic County Jail pending the disposition of the charges.
An arraignment on the Indictment has been scheduled for September 13, 2021 in State Superior Court.
