A PASSAIC NEW JERSEY MAN DETAINED FOR KIDNAPPING AND SEXUAL ASSAULT OF A JUVENILE VICTIM

PASSAIC, NJ.- On Thursday, August 5, 2021 Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announced the Pretrial Detention of Eloy Tomay Coyotl, 32, from Passaic, New Jersey. Mr. Tomay Coyotl was arrested without incident on July 30, 2021, after an investigation conducted by the Passaic Police Department, with assistance from the Passaic County Prosecutor’s Office.
Mr. Tomay Coyotl is Charged with First Degree Aggravated Sexual Assault, Second Degree Sexual Assault, First Degree Kidnapping, Third Degree Aggravated Criminal Sexual Contact, Fourth Degree Criminal Sexual Contact, Third Degree Criminal Restraint, Second Degree Luring, and Third Degree Endangering the Welfare of a Child.
On May 17, 2021, Bloomfield Police Department and Passaic Police Department responded on a report of a Sexual Assault. After speaking with the 17-year-old victim, from Bloomfield, and witnesses, the investigation revealed that Mr. Tomay Coyotl pulled the victim into his car, drove through Bloomfield and into Passaic, then digitally penetrated the victim while in his vehicle.
The Sentencing exposure on First Degree Aggravated Sexual Assault is Ten to Twenty Years in New Jersey State Prison with 85% o term of service before Parole Eligibility pursuant to The No Early Release Act; on Second Degree Sexual Assault it is Five to Ten Years in New Jersey State Prison with 85% term of service; on First Degree Kidnapping is Fifteen to Thirty Years with 85% term of service pursuant to The No Early Release Act; on Third Degree Aggravated Criminal Sexual Contact is Three to Five Years in New Jersey State Prison; on Fourth Degree Criminal Sexual Contact is a maximum of Eighteen Months in New Jersey State Prison; on Second Degree Luring is Five to Ten Years in New Jersey State Prison; and on Third Degree Endangering the Welfare of a Child is Three to Five Years in New Jersey State Prison. If convicted, Mr. Tomay Coyotl will also be subject to Parole Supervision for Life and Megan’s Law registration Requirements.
At a detention hearing on Monday, August 3, 2021, the Honorable Marilyn C. Clark, J.S.C. granted the State’s motion for the pretrial detention of Mr. Tomay Coyotl.
