PATERSON, NJ.- On Wednesday, July 21, 2021 Passaic County Prosecutor Camelia M. Valdes and Passaic County Sheriff Richard H. Berdik announced the Pretrial Detention of Delbin Noesi Gonzalez, 39, of Paterson, New Jersey. Mr. Noesi Gonzalez was arrested without incident on Thursday, July 15, 2021, after an investigation conducted by The Passaic County Sheriff's Office Internet Crimes Against Children (ICAC) Task Force.
Mr. Noesi Gonzalez was Charged with One Count of Second Degree Leader of a Child Pornography Network; One Count of Second Degree Possession of Child Pornography; One Count of Second Degree Distribution of Child Pornography; and One Count of First Degree Storing and Maintaining Child Pornography on a File Sharing Program.
The Sheriff's Office ICAC Task Force began an investigation into an individual, later identified as Mr. Noesi Gonzalez, who was using the internet to obtain, distribute, and maintain electronic files depicting the Sexual Exploitation or Abuse of Children under the age of eighteen years old. The investigation revealed that Mr. Noesi Gonzalez distributed images and videos portraying child pornography to others by the way of Facebook Messenger.
The images and videos recovered from Mr. Noesi Gonzalez depicted nude children, ranging in the age from approximately a few months old to fourteen years old, engaged in sexual acts.
The sentencing exposure on Second Degree Leader of a Child Pornography Network, Possession of Child Pornography, and Distribution of Child Pornography is Five to Ten Years in New Jersey State Prison; and on First Degree Storing or Maintaining Child Pornography on a File Sharing Program is Ten to Twenty Years in New Jersey State Prison, with a mandatory minimum sentence between One Third and One Half of the total sentence imposed. If convicted, Mr. Noesi Gonzalez is also subject to Parole Supervision for Life and Megan's Law Registration Requirements.
At a Detention Hearing on Tuesday, July 20, 2021, The Honorable Imre Karaszegi, J.S.C. granted the State's Motion for the Pretrial Detention of Mr. Noesi Gonzalez.
