PASSAIC, NJ.- On Wednesday June 9, 2021, Passaic County Prosecutor Camelia Valdes, Paterson Police Chief Ibrahim Baycora, and Elmwood Park Police Chief Michael Foligno announced that based upon an investigation by The Paterson Police Department in conjunction with The Elmwood Park Police Department, Brandon Diaz, 21, of Paterson, New Jersey, was arrested in relation to a shooting investigation that took place on March 14, 202, in the area of 20th Avenue and Jackson Street in Paterson, New Jersey.
Brandon Diaz has been charged with Second Degree Unlawful Possession of a Handgun; Second Degree Possession of a Weapon fo an Unlawful Purpose; and Fourth Degree Aggravated Assault, relative to the March 14th incident.
On March 14, 2021, members of the Paterson Police Department responded Saint Joseph's University Medical Center in Paterson after a 21-year-old male Paterson resident arrived at the hospital seeking treatment for a non-life threatening gunshot wound. The ensuing investigation revealed that a gunman had accidently shot the victim while they were both in a parked vehicle, near 20th Avenue and Jackson Street in Paterson New Jersey.
Based on the investigation, Brandon Diaz was identified as the shooter and on March 17, 2021, a warrant was issued for his arrest. On June 5, 2021, at 11:56 a.m., Mr. Diaz was arrested by The Elmwood Park Police Department after a motor vehicle stop in the area of Stefanic Avenue. During the investigation members of The Elwood Park Police located a stolen 9 millimeter Taurus pistol with hollow point bullets inside the car. Brandon Diaz was charged on a Bergen County Complaint with regard to th June 5, 2021 incident in Elmwood Park.
The sentencing exposure for Brandon Diaz on Second Degree Unlawful Possession of a Handgun is 5 to 10 years in a New Jersey State Prison, with a minimum of 42 months of service before parole eligibility, pursuant to The Graves Act. On Second Degree Possession of a Weapon for an Unlawful Purpose is 5 to 10 years in a New Jersey State Prison, with a minimum of 42 months of service before parole eligibility, pursuant to The Graves Act. On Fourth Degree Aggravated Assault is up to 18 months in New Jersey State Prison.
The State will file a motion for pretrial detention that will be heard in State Superior Court.
