PENNSYLVANIA'S HIGHEST COURT VACATES BILL COSBY'S 2018 CONVICTION

COLLEGEVILLE, PA.-Today, Pennsylvania Supreme Court, in a 79-Page Ruling, The Court overturned and vacated Bill Cosby's 2018 Sexual Assault Conviction, Barring Prosecutor's from presenting the case for a third trial.
On Wednesday June 30, 2021, Pennsylvania Supreme Court overturned Bill Cosby's Sexual Assault Conviction, after finding an agreement with a previous prosecutor prevented him from being charged in the case.
The Court Ruling today resulted from an agreement Mr. Cosby struck with District Attorney Bruce Castor, in 2005, wherein Mr. Castor declined to prosecute Mr. Cosby in exchange for testimony during a Civil Trial.
The Justices Ruled that the agreement prevented prosecution for the claims brought by Andrea Constant, the former Director of Operations for Temple University's women's basketball team, and wrote that the Prosecutorial Discretion of Pennsylvania's District Attorneys was not " Free Of The Constraints Of Due Process."
Mr. Cosby " must be discharged, and any future prosecution on these particular charges must be barred," they wrote. " We do not dispute that this remedy is both severe and rare. But it is warranted here, indeed compelled."
Today's news comes after Bill Cosby was denied Parole after he declined to participate in a sexual violence program conducted in the prison, with his attorneys arguing at the time, that participation in such program would make their client appear guilty.
Today's Supreme Court Ruling, may pave the way for now imprisoned Harvey Weinstein's conviction to be overturned and remanded for retrial in the future.
